# Steward Health Care — TRACO and Steward: captive insurance, IOUs and malpractice claims

**Question.** Why do the record’s intercompany balances and insurance disputes require separate treatment?

**Answer.** The retained accounts identify TRACO as Steward’s captive insurer but describe competing obligations and unresolved coverage disputes. A service ruling does not decide the ultimate insurance liability.

## Captive insurance and competing intercompany balances

- Analysis: Steward’s financial statements identify TRACO International Group S. de R.L., domiciled in Panama, as the captive insurer for professional and general liability coverage. The estate’s investigation describes claims funded by SHCS and intercompany amounts it says TRACO owed SHCS. In contrast, October 2026 reporting describes TRACO pressing for roughly $250 million owed by Steward on its IOUs, alongside unresolved malpractice settlements and clinicians facing personal payment orders. - Qualification: Opposing balances may concern different transactions or ledgers; they are not silently netted. A 2016 lease names Tailored Risk Assurance Company Ltd as an acceptable insurer, but the retained passage does not prove that it is the identical legal entity as the later Panama company.
  - Response: The October 2026 account recalls Callum and King-Shaw telling physicians in September 2024 that funds would be reserved for claims and old claims would continue to be defended.
  - Outcome: The June 2025 Goff decision concerns service in a claim alleging non-payment of a $535,000 settlement; it does not itself decide the insurer’s ultimate liability. The later reports describe continuing coverage disputes, not a completed global resolution.
